when i upload the file to phpmy admine it says

Error
There seems to be an error in your SQL query. The MySQL server error output below, if there is any, may also help you in diagnosing the problem

ERROR: Unknown Punctuation String @ 1
STR: <?
SQL: <?php

is there a way to fix this?

You can try commenting out the line
if (!is_admin($admin)) { die ("Sorry you are not an administrator, You can not install this module"); }

But it sounds more like some other issue register globals off maybe?
